First name change

Anyone can ask to change their first name.
Under article 60 of the French Civil Code, you can only apply to change your first name at the Mairie d'arrondissement of your place of residence, or in the commune or arrondissement of your place of birth (where the birth certificate was drawn up).
Please note
First-name change applications are usually submitted by appointment. For more information, please contact your local Mairie d'arrondissement .

It is not possible to complete this procedure on Saturday mornings at your Mairie.
(Saturday mornings are reserved for births, deaths and marriages).
If the registrar considers that your request has no legitimate interest, he or she must refer the matter to the public prosecutor. If the public prosecutor refuses, you can appeal to the family court.

Anyone can ask to change their first name.

Example: Your first name or the junction between your surname and first name is prejudicial to you, other people (parents, brothers, sisters, employers, colleagues, etc.) call you by a first name other than your original one.

You can also request the addition of a first name, the deletion of a first name or a change in the order of first names.

The interested party personally submits his or her request for a change of forename, specifying the reasons, to the town hall where he or she lives or to the town hall where he or she was born. The civil registrar is responsible for assessing the admissibility of the request. It is the civil registrar's responsibility to refer the matter to the public prosecutor if he or she considers that the request is not in the public interest. If the public prosecutor opposes the change, the applicant may refer the matter to the family court.

The City of Paris has made a number of commitments to facilitate the process for all requests to change a first name linked to transidentity:
- We listen carefully to you when you visit our civil registry offices.
- We'll help you put together the right file to change your first name.
- You will not be asked to provide any medical documents to support your request.
- Your request to change your first name will not be assessed on the basis of your physical appearance.
- You will not be asked to provide a photo of yourself, other than that of your identity document.
- A rapid response from the Paris Mairie d'arrondissement (within 15 days of submission of a complete application)
You are free to choose your new first name(s). The first name chosen can be a "neutral" first name, or a combination of first names of different genders.

The applicant submits his or her request to change his or her first name in person at the town hall where he or she lives, or at the town hall where he or she was born. If the applicant is a minor, the request must be made by his or her legal representative. If the request is made on behalf of a minor over 13, the child's consent is required.

The decision is recorded in the civil register. The birth certificate is updated. The person concerned can produce his or her birth certificate to justify the name change to the various authorities.

Change of surname

It is possible to change one's surname by making a declaration to the registry office. An adult may choose to bear the name of his or her mother, father or both.
Any adult can change his or her surname simply by taking, by substitution, the name of the parent who was not transmitted to him or her at birth, and by declaring his or her choice on a form to be submitted to the town hall of his or her place of residence or birth(article 61-3-1 of the French Civil Code).
The Ministry of Justice has published an explanatory circular, giving examples of different situations.

Name change requests are reserved for adults only.
Parents exercising parental authority cannot use this procedure to request a name change for their minor child.

You can change your surname to :
- Your mother's surname ;
- Your father's surname;
- Part of your mother's surname, if her surname is in two parts (1st part / 2nd part);
- Part of your father's surname, if his surname is in two parts (1st part / 2nd part);
- The names of your parents together in the order chosen, with a limit of one name for each parent.

You can submit your request for a change of name to your local Mairie (in Paris, the Mairie of the arrondissement where you live) or to the Mairie where you were born.

Filing a family name change application requires an appointment for minors: please make an appointment, and no appointment is required for adults.

You can submit your request for a change of name at the counter of your home town hall or your birth town hall.
You can also send your request for a change of name by post to your home town hall or your birth town hall.
Please note that when you confirm your request for a change of name, one month after submitting or receiving your file at your Mairie de domicile or Mairie de naissance, you must go in person to the Mairie where you submitted your request, to confirm your wish to change your surname.

The applicant does not have to demonstrate a legitimate interest in changing his or her surname.
The surname change request file must include the following items:
- A completed surname change request form :

>> Information leaflet
- Recent proof of address;
- Proof of identity (identity card, passport, etc.);
- A full copy of the applicant's birth certificate less than three months old (on the date the application is submitted to the town hall);
- A full copy of the birth and marriage certificates, dated within the last three months, of the other persons concerned by the name change request (birth certificates of the applicant's children, spouse or partner if the union or civil solidarity pact has not been dissolved, marriage certificates of the children if their union has not been dissolved).

Step 1: compiling your family name change file (see "What should a family name change file contain?" above)

Step 2: Submitting your request to change your surname to your local Mairie or the Mairie where you were born.

Step 3: The Mairie where you submit your request confirms that your family name change application is complete.
If your file is not complete, the Mairie where you are making your request will inform you of the items to be added to your family name change file.
The civil registrar may refer the matter to the public prosecutor in the event of difficulty.

Step 4: Wait one month between receipt of your request by your home town hall or birth town hall and confirmation of your wish to change your surname(article 61-3-1 of the French Civil Code).
Confirmation cannot take place before the expiry of the one-month period from the date of receipt of the request. If the first day after expiry of the one-month period is a Saturday, Sunday or public holiday, the period is extended to the next working day.

If the applicant does not confirm the name change request by the confirmation date, or in the days and weeks following the confirmation date, the request may be archived by the Mairie.

Step 5: Confirmation at the town hall where you submitted your application. You must go in person to the town hall to confirm your wish to change your surname.[Appointment required at some mairies (2)].

Step 6: The registrar will record your family name change in the civil register and inform the birth and marriage town halls concerned by your name change (to update the records submitted with your name change file).

Step 7: Fifteen days after your family name change has been recorded, you can request the issue of updated civil status certificates from the relevant town halls.

If your child is under thirteen, the change of surname is automatic, if your child bears your name or part of your name.
If your child is aged thirteen or over, the change of surname is not automatic. To change their surname, they must give their consent.
Consent to change a surname for children aged thirteen or over must be completed on the CERFA form requesting a change of name.
If your child has reached the age of majority, he or she can benefit from your name change, if he or she consents.

Changing a child's name after birth

When a birth is registered, a child whose birth certificate shows only one parent is given that parent's surname.
When the second parent recognizes the child, the child's name can be changed under certain conditions (article 311-23 of the French Civil Code).

Only children under the age of 18 (who are therefore minors) can benefit from this surname change procedure.

If, at the child's birth, the child's parents are married to each other, this surname change procedure cannot be applied to the child.

The conditions for benefiting from this surname change procedure also depend on the child's date of birth:
- If the child was born before July 1, 2006, two conditions must be met: the parent-child relationship with the child must have been established separately, and one of the acknowledgments (of the child's father or mother) must have been established after the child's birth certificate was drawn up.
- If the child was born after July 1, 2006, one condition must be met: the father's parent-child relationship with the child (the acknowledgement deed) must have been established after the child's birth certificate was issued.

The parents jointly decide to :
- replace the birth name with the name of the parent who recognized the child after the declaration of birth
- transmit the names of both parents together, in the order of their choice

The parents appear together before the registrar of their choice.

They provide :
- The declaration of family name change for a minor child

The joint declaration of family name change is recorded in the civil register at the town hall, and signed by the parents and the registrar.

If a serious reason prevents one of the parents from coming to the Mairie, he/she can be represented by a person mandated to represent him/her.
The person appointed to represent the parent who is unable to attend must produce a special, authenticated power of attorney (drawn up by a bailiff or notary) when the child's surname is changed at the Mairie.

The change of surname is recorded in the margin of the child's birth certificate.

The surname chosen for the child will apply to subsequent children if they have the same parents.

Change of surname for legitimate reasons

Any person who can demonstrate a legitimate interest may apply to change their surname (article 61 of the French Civil Code).
You can ask to change your surname if you have a legitimate reason. For example, a name that is difficult to bear because it is perceived as ridiculous or derogatory. There are 2 steps involved. First, you need to publish your request in the Journal officiel (JO) and in a journal d'annonces légales (Jal). You are responsible for the cost of publication. You must then send your request to the Minister of Justice.

Rectification of a civil status record

Some civil status records may contain clerical errors. For example, a first name may have been forgotten or a surname misspelled. In this case, you should ask for the record to be rectified.

Civil registrars are empowered to rectify certain material errors in civil status records(article 1047 of the French Code of Civil Procedure).
In the cases listed below, your request for rectification must be made to the district town hall holding the civil status record to be rectified:
- Deletion of a double hyphen in a surname;
- Correction of an error in a civil status record, when the error can be proven by presentation of a French birth certificate (of the person concerned or his/her parent).

On the other hand, the Mairie d'arrondissement is not competent to rectify all material errors in civil status records. Indeed, when an error in a civil status record is proven by the presentation of a foreign birth certificate (of the person concerned or his/her parent), the rectification can only be carried out on the instructions of the Procureur de la République of the Tribunal judiciaire de Paris. The file should then be sent by post to the following address:

The rectification request must include :

- the purpose of the request: using the form for rectification of a material error or on plain paper ;
- a complete copy of the document to be rectified;
- the documents indicated on page 2 of the rectification of a material error form (for example: if the spouse's surname is incorrect on his or her marriage certificate celebrated in Paris, you will also need to provide his or her birth certificate, which shows the correct spelling), - a photocopy of your identity document (national identity card, passport, etc.).

You or your child have a surname consisting of two parts separated by a double hyphen (- -).
You can ask for the double hyphen to be removed and replaced by a space between the two parts of your or your child's name.
If you request the deletion of the double hyphen from your surname, it will be indicated in the civil records that the surname is composed of two parts.
Thus, Mr. GRAND - - PETIT will be called : GRAND PETIT (1st part: GRAND 2nd part: PETIT).
If you wish to do this, you need to fill in a request form(see below) for the removal of the double hyphen and send this document, together with the civil status record(s) you wish to rectify, to the commune of your place of birth or that of your child.
